Right of Withdrawal Legislative Decree 206/2005 (Consumer Code)

Warranty, Returns and Refunds

All pens are delivered with a certificate of authenticity guaranteeing that they are handcrafted, finished and carefully checked as the highest Italian goldsmith tradition requires.

For each of our writing instruments we provide a qualified assistance, maintenance and repair service, taking care of cleaning pens, refills, cartridges and reservoirs, as well as replacing any damaged parts.

Our pens come with a 2-year European statutory warranty on manufacturing defects. In addition, all pens come with a 14-day money back guarantee after the date of receipt of the package.

The consumer has the right, within a period of 14 days after receipt of the goods, to exercise the Right of Withdrawal. This right consists of the right to return the purchased goods to the seller, and the consequent refund of the purchase price, meaning the net amount paid for the goods excluding additional expenses such as packaging, labour, transport, and cash-on-delivery taxes. In particular, the consumer who intends to avail himself of the Right of Withdrawal must send the seller an appropriate communication within 14 days of receipt of the goods.

Notice of withdrawal shall be sent by registered letter with acknowledgement of receipt or by telegram or fax, confirmed by registered letter with acknowledgement of receipt within 48 hours, to the address declared by the shop from which the goods originated. The communication must contain the codes of the articles that the consumer wishes to return, the bank details for the refund, and a tax document with “exercise of the right of withdrawal on dd/mm/yy” written in his or her own hand followed by a signature.

The consumer must also return the undamaged and perfectly packaged products to the shop in question at the address declared by the latter within 30 days from the date of their receipt. The cost of the return shipment shall be borne by the consumer.

Exclusion from the Right of Withdrawal

The right of withdrawal applies to natural persons (consumers) acting for purposes that can be considered unrelated to their business activity. Purchases made with a VAT number are therefore excluded. Unless otherwise agreed between the parties, the consumer may not exercise the Right of Withdrawal for contracts for the supply of goods and services whose price is linked to fluctuations in financial market rates that the supplier is unable to control.
